How do I find a solicitor?
Families in England, Wales, and NI with a child with learning difficulties can contact Mencap Wills and Trust department for a list of solicitors and legal professionals they have approved. You can contact them by phone 020 7696 6925 or by email willsandtrusts@mencap.org.uk. Families in Scotland can contact ENABLE Scotland 0141 226 4541 or trustee@enable.org.uk.
Can I use a Will Writing Service? They say they work with solicitors and they have the work ‘Legal’ on their website and literature?
At the moment will writing services are not regulated in the UK. We will only pay Solicitors or legal Professionals that are covered by the Legal Ombudsman
The solicitor that I phoned wants to charge much more than the £350 allowed on the Voucher.
We recommend that you shop around. Quite a few firms of solicitors give families with a Cerebra Voucher a concessionary rate.
Do I need a Discretionary Trust?
Ask the solicitor. If you do not own your home or have much capital or assets, it may not be necessary. If there is a possibility of an inheritance (or winning the lottery!) it might be good to put a discretionary trust in place.
How long will it take to hear of a decision about my application?
At present we hope to give you a decision within 2 months.
How long is the Voucher valid for?
The Voucher will be valid for 12 months from the date of us sending you the Voucher. It is important therefore to arrange an appointment with a solicitor as soon as possible.
